Illegal Search and Seizure
Nearly all drug cases are affected by Fourth Amendment search and seizure law. The first thing I do when I have a client accused of a drug crime is to analyze the legality of the search. According to the Fourth Amendment of the U.S. Constitution, "The right of the people to be secure... against unreasonable search and seizure shall not be violated... "
If the search is illegal, whatever the authorities found during the search cannot be used against you under the "fruit of the poisonous tree doctrine." If I bring a motion to suppress evidence and I can prove that the search was illegal, my client will walk away free. I've won cases based solely on this motion, even on appeal.
Other Defense Options
There may be several defense options that apply, even with a conviction. Very rarely do my clients go to jail, especially in drug cases. There are a variety of treatment programs available. According to Proposition 36, persons charged with using or possession of drugs for personal use can do probation and treatment instead of jail. The person pleads guilty and goes through the program. If they are successful, the case is dismissed, and the record is expunged. They start over with a clean slate.
